Guardianship
There are literally thousands of Texans each year who become unable to make decisions for themselves due to accident, disease or infirmity. When this occurs, the law requires someone else to decide for the incapacitated person. Yet, if the incapacitated person did not have planning documents in place before his/her incapacitating condition occurred, a legal guardianship may be necessary. Most people don’t realize, however, that in the vast majority of cases, guardianship can or must be avoided if sufficient and valid estate planning documents are in place. Guardianship is a specialized area of the law designed to protect vulnerable persons from abuse, neglect (including self-neglect) and exploitation caused by any number of physical or mental incapacities.
